General Terms and Conditions

These General Terms and Conditions govern all online registrations for weekly group theatre classes offered by JN Theatre Studio.

1. Service Provider

The theatre classes covered by these General Terms and Conditions are provided by:

JN Theatre Studio
Jane NAPP – Individual Entrepreneur
French micro-enterprise
7 rue des Châtaigniers
67100 Strasbourg
France

Business registration number: SIRET: TO BE ADDED

Email: info@jntheatrestudio.com

Website: www.jntheatrestudio.com

2. Purpose and Scope

These General Terms and Conditions define the contractual relationship between JN Theatre Studio and any person registering for a weekly group theatre class.

They apply to adults and minors, subject to the specific provisions applicable to minors set out below.

Completing an online registration and making the required payment constitutes full and unconditional acceptance of these General Terms and Conditions.

The version applicable to an order is the version available on the website on the date the registration is completed.

3. Description of the Classes

JN Theatre Studio offers programmes consisting of 16 weekly group theatre sessions.

The content, teaching methods, exercises and artistic direction of the classes are determined by Jane NAPP according to the group, participants' level and educational objectives of the programme.

The exact dates, times, location and schedule of the 14 - 16 sessions are determined by JN Theatre Studio and communicated to participants before the beginning of the programme.

Registration does not guarantee a particular role, performance, speaking time, artistic result or level of progress.

4. Trial Session

A participant may attend a trial session at a price of €15 including all taxes.

When the participant subsequently registers for the complete 14 - 16-session programme, the €15 paid for the trial session is deducted from the total programme price.

The deduction applies only to the participant who attended the trial session and cannot be transferred to another person.

Unless otherwise expressly agreed by JN Theatre Studio, the trial session is not refundable if the participant decides not to register for the complete programme.

5. Registration

Registration is completed online through the JN Theatre Studio website or through any online registration process made available by JN Theatre Studio.

The customer is responsible for ensuring that all information provided during registration is complete, accurate and up to date.

Registration becomes final only after:

  • the online registration form has been completed;
  • these General Terms and Conditions have been accepted;
  • full payment has been successfully received; and
  • confirmation of registration has been issued by JN Theatre Studio.

JN Theatre Studio may refuse or cancel a registration where the group is full, the participant does not meet any requirement stated for the class, payment has not been completed, or there is a legitimate reason relating to safety or the proper organisation of the class.

6. Prices and Payment

The price of the complete 14 - 16-session programme is €320 - €390 including all taxes.

Where the participant has attended and paid for a €15 trial session, the remaining amount payable for the programme is €305 - €375 including all taxes.

Payment must be made in full at the time of registration.

The available payment methods are those displayed during the online registration process.

JN Theatre Studio is not required to reserve a place until full payment has been received.

Any bank charges, rejected payment fees or other costs resulting from the customer's payment method remain the customer's responsibility, to the extent permitted by law.

7. Right of Withdrawal

Where a registration is concluded online by a consumer, the consumer generally has a legal period of 14 days from the conclusion of the contract to exercise their right of withdrawal, without having to provide a reason.

The consumer may exercise this right by sending an unambiguous written statement to: info@jntheatrestudio.com .

Where the consumer expressly requests that the classes begin before the end of the 14-day withdrawal period, the consumer acknowledges that:

  • if the right of withdrawal is exercised after the service has begun, the consumer may be required to pay an amount proportionate to the services already provided;
  • once the service has been fully performed, the right of withdrawal may be lost where performance began with the consumer's prior express request and acknowledgement.

These provisions do not limit any mandatory right granted to the consumer by applicable law.

8. Cancellation or Absence by the Participant

Once the applicable withdrawal period has expired, or where the right of withdrawal no longer applies, registration is considered firm and final.

A session missed or cancelled by the participant is not refundable, exchangeable or transferable.

A missed session cannot be postponed, replaced or credited against another session or future programme.

The full programme price remains payable even if the participant:

  • does not attend one or more sessions;
  • arrives too late to participate;
  • voluntarily stops attending the programme;
  • is temporarily unable to attend for personal or professional reasons.

Exceptionally, JN Theatre Studio may agree to a full or partial refund where the participant provides evidence of a serious and valid reason.

Serious and valid reasons may include, depending on the circumstances, a significant medical condition, accident, bereavement, permanent relocation or another exceptional event that makes continued participation reasonably impossible.

Each request is assessed individually by JN Theatre Studio. The granting of a refund in one case does not create any right or precedent for another case.

9. Cancellation or Rescheduling by JN Theatre Studio

Where JN Theatre Studio is unable to provide a scheduled session, the session will be rescheduled.

Participants will be informed of the replacement date as soon as reasonably possible.

A change to the date, time, teacher or location of a session does not automatically entitle the participant to a refund, provided that the session is rescheduled under reasonably comparable conditions.

JN Theatre Studio may also adjust the overall schedule where necessary for organisational, artistic, safety or operational reasons.

Where a session or programme cannot be rescheduled, JN Theatre Studio will offer an appropriate solution, which may include a credit, replacement service or proportionate refund for the service not provided.

10. Punctuality and Access to Classes

Participants are expected to arrive on time and to follow any access or arrival instructions communicated by JN Theatre Studio.

Significant lateness may disrupt exercises, group work or safety instructions.

JN Theatre Studio may therefore refuse access to a session where a participant arrives significantly late.

Refusal of access due to lateness does not entitle the participant to a refund, replacement session or credit.

11. Conduct and Exclusion

Participants must behave respectfully towards the teacher, other participants, staff, visitors and the premises used for the classes.

The following conduct is prohibited:

  • violent, threatening or intimidating behaviour;
  • harassment, discrimination or abusive language;
  • deliberately dangerous conduct;
  • damage to equipment or premises;
  • repeated disruption of the class;
  • failure to comply with reasonable safety or teaching instructions;
  • any conduct that endangers or seriously affects another participant or the proper operation of the class.

JN Theatre Studio may issue a warning, temporarily suspend access or permanently exclude a participant where their conduct is dangerous, violent, seriously disrespectful or repeatedly disruptive.

Where exclusion is justified by the participant's conduct, no refund, credit or replacement session will be provided, subject to applicable mandatory law.

12. Health and Safety

Each participant is responsible for ensuring that they are physically and medically able to take part in the activities offered.

Before participating, the participant must inform JN Theatre Studio of any known medical condition, injury, disability, allergy, pregnancy or other health issue that may:

  • affect their ability to participate safely;
  • require a reasonable adjustment;
  • affect the safety or well-being of another participant;
  • affect the proper conduct of the class.

For a minor, this information must be provided by the parent or legal representative.

The participant remains responsible for following medical advice and for stopping any exercise that causes pain, discomfort or unusual symptoms.

JN Theatre Studio may refuse or restrict participation where it reasonably considers that participation creates a significant health or safety risk.

13. Responsibility and Personal Belongings

JN Theatre Studio is responsible for the proper performance of its contractual obligations under the conditions provided by applicable law.

JN Theatre Studio cannot be held liable for damage resulting from:

  • a participant's failure to follow safety, health or teaching instructions;
  • inaccurate or incomplete health information supplied by the participant;
  • the participant's own negligent or dangerous behaviour;
  • an unforeseeable and unavoidable act of a third party;
  • an event of force majeure.

Participants remain responsible for their personal belongings. JN Theatre Studio accepts no responsibility for items that are lost, forgotten, damaged or stolen, except where liability cannot legally be excluded.

Nothing in these General Terms and Conditions excludes or limits any liability that cannot lawfully be excluded or limited.

14. Minors

Registration for a minor must be completed by a parent or legal representative.

By completing the registration, the parent or legal representative:

  • accepts these General Terms and Conditions;
  • authorises the minor to participate in the classes;
  • confirms that all necessary health and emergency information has been provided;
  • remains responsible for the minor before the class begins and after it ends.

A minor must not leave the class location alone unless prior authorisation has been given by their parent or legal representative.

The authorisation should be provided in writing and may be withdrawn or amended by the legal representative at any time by contacting JN Theatre Studio.

Unless such authorisation has been given, the parent or authorised adult must collect the minor at the end of the class.

15. Photographs and Videos

Photographs or videos may be taken during classes, rehearsals, workshops, performances or related events.

The mere presence of a participant at a class or event does not constitute consent to the public use or publication of their image.

Any identifiable photograph or video intended for publication, promotional use, social media, the website or other public communication will be subject to prior authorisation from the participant.

For a minor, prior written authorisation must be obtained from their parent or legal representative.

Refusal to authorise publication of a participant's image will not affect their eligibility to attend the classes.

The scope, purpose, media and duration of any image authorisation may be specified in a separate image release form.

16. Personal Data

Personal data provided during registration is processed for the purposes of:

  • managing registrations and payments;
  • organising and administering classes;
  • communicating with participants or legal representatives;
  • managing health, safety and emergency information;
  • complying with legal and accounting obligations.

Further information regarding personal data, retention periods and participants' rights is provided in the website's Legal Notice or privacy information.

Requests concerning personal data may be sent to: info@jntheatrestudio.com .

17. Force Majeure

Neither party shall be held liable for a failure or delay resulting from an event beyond its reasonable control and recognised as force majeure under French law.

Such events may include, depending on the circumstances, severe weather conditions, fire, flood, epidemic, public authority restrictions, transport disruption, closure of the premises or any other event preventing the safe provision of the classes.

Where possible, JN Theatre Studio will seek to reschedule affected sessions or offer an appropriate alternative solution.

18. Complaints

Any complaint relating to a registration, payment or class must first be submitted in writing to:

info@jntheatrestudio.com

The complaint should include the participant's name, relevant registration details, a clear description of the issue and any supporting documents.

JN Theatre Studio will make reasonable efforts to examine and respond to the complaint as soon as possible.

19. Consumer Mediation

After first submitting a written complaint directly to JN Theatre Studio, and where the dispute has not been resolved amicably, the consumer may refer the matter free of charge to the consumer mediator appointed by JN Theatre Studio.

The consumer may use the mediation service subject to the conditions and eligibility rules established by the appointed mediator.

20. Applicable Law and Jurisdiction

These General Terms and Conditions and the contractual relationship between JN Theatre Studio and the customer are governed by French law.

The parties shall first attempt to resolve any dispute amicably.

If no amicable resolution is reached, the dispute may be submitted to the competent courts in accordance with applicable procedural and consumer protection rules.

Nothing in this clause deprives a consumer residing in another country of any mandatory protection granted by the law applicable to them.

21. Severability

If any provision of these General Terms and Conditions is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply.

The invalid provision will, where possible, be replaced by a valid provision reflecting as closely as possible its original purpose.

22. Amendments

JN Theatre Studio may update these General Terms and Conditions to reflect changes in its services, organisation or applicable law.

Any updated version applies only to registrations completed after its publication, unless a change is required by law or expressly accepted by the customer.
